THIS AGREEMENT SHALL GOVERN THE USE OF NTOGO.COM WEB SITE AND ITS SERVICES. BY USING THIS WEB SITE, YOU SHALL BE DEEMED TO HAVE READ AND ACCEPTED THESE TERMS AND CONDITIONS OF USE WITHOUT VARIATION, SET OUT HEREIN WHICH MAY BE AMENDED BY NTOGO.COM (HEREINAFTER ALSO REFERRED TO AS NToGo ) FROM TIME TO TIME WITHOUT PRIOR NOTICE TO YOU. IF YOU DO NOT AGREE WITH ANY PART OF THE FOLLOWING TERMS OR CONDITIONS, YOU MUST NOT USE THIS WEBSITE.
GENERAL TERMS AND CONDITIONS:
1. USER'S OBLIGATIONS
a. There should be no unlawful use of NToGo.com website other than for your personal use. It shall not be used in anyway that may harm, damage, disable, interfere or impair the enjoyment and availability of NToGo, our partner(s) and our customers.
2. REPRESENTATIONS & WARRANTIES
You represent and warrant that:
a. You are of sufficient legal age to use this website in accordance with all terms and conditions herein and to create binding legal obligations for any liability you may incur as a result of the use of this website.
b. You are financially responsible for all uses of this website by you and those you are acting on behalf and those acting on your behalf.
c. You will not post or transmit any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage conduct that would be considered a criminal offence, give rise to civil liability, or otherwise violate any law.
d. You will not use this website to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand.
e. All information supplied by you in using this website are true and accurate.
3. SOFTWARE AND COPYRIGHT
a. NToGo retains all rights (including, but not limited to trademark rights, copyright and patent rights) with respect to all software, information or material on this website.
b. You are not to download or export any software, information or material on this website, except to the extent that such downloading occurs in the course of using this website in accordance with our written instructions or otherwise as expressly permitted in this Agreement.
This clause shall survive any termination of this Agreement.
4. DISCLAIMER, NO WARRANTY AND LIABILITY LIMITATION
a. Services provided by NToGo are made available on an "as is" and "as available" basis. Under no circumstances, including negligence (including but not limited to typographical errors, technical inaccuracies, etc), shall NToGo.com guarantee, warrant or be liable that the use of this website will be uninterrupted or error free or that any information, data, content, software or other material accessible through this website will be free of bugs, viruses, worms, Trojan horses or other harmful components.
b. NToGo does not guarantee, warrant or make any representations of any kind either express or implied on the timeliness, correctness, authenticity or accuracy of the information posted or made available on our website . All website information are subject to change without prior notice at any time, as informed by the respective airlines, ticket resellers/agents, partners, regulatory authorities and any other external parties.
c. NToGo shall not be liable for damages of any kind arising out of any failure or delay by NToGo in performing any or all of our obligations contained herein or in respect of any product or service if the failure or delay is due to circumstances or cause beyond our reasonable control.
d. NToGo shall not be liable for any direct, indirect, special, incidental or consequential damages arising out of or in any way connected with the use of or inability to use this website, or the information, products and services obtained through this website, the submission of any personal information, including, but not limited to, bank and credit card details, the performance or non-performance by NToGo, or any unauthorised access or breach of security into this website through the internet or otherwise arising, whether based on contract, strict liability, negligence, product liability or otherwise even if NToGo has been advised of the possibility of such damages.
This clause shall survive any termination of this Agreement.
5. CANCELLATION OF SERVICE
a. NToGo may, at any time and at its sole discretion and without cause or notice, terminate or restrict your access to this website or refuse to give effect to any booking or reservation requested by you without being required to give any reasons or advance notice to you.
6. INDEMNITY
a. You shall indemnify and keep NToGo indemnified against all claims, demands, actions, proceedings made or brought against NToGo arising from your use of this website and/or any breach of any term or condition by you.
7. LINKS TO THIRD PARTIES
a. This website may contain hyperlinks to websites operated by parties other than NToGo. This does not imply NToGo's endorsement of such websites nor any association with their operators. NToGo is not responsible for the contents of other websites.
8. SEVERABILITY
Any provision of this Agreement, which is invalid, prohibited or unenforceable in any jurisdiction, shall:
a. Be ineffective in that jurisdiction to the extent of the invalidity, prohibition or unenforceability.
b. Not invalidate the remaining provisions of this Agreement.
c. Not effect the validity of that provision in any other jurisdiction.
9. ADDITIONAL TERMS AND CONDITIONS
a. Additional terms and conditions will apply to your booking and purchase of our products and services. You agree to abide by NToGo's conditions of purchase and/or the terms and conditions of any supplier of the travel-related products or services.
10. ENTIRE AGREEMENT
a. This Agreement is the entire agreement between the parties in respect of its subject matter and supersedes all prior understandings or agreements (whether oral or written) regarding the subject matter.
11. GOVERNING LAW
a. This Agreement shall be governed by and construed in accordance with the laws of Singapore and you submit to the non-exclusive jurisdiction of the courts of Singapore.
ADDITIONAL SALES TERMS AND CONDITIONS
1. AIR TICKETS/COACH TICKETS PURCHASE
a. All fares and taxes quoted are subject to changes with or without prior notice. Fares and taxes quoted can only be confirmed upon issuance of air tickets and/or other related travel products/services.
b. Tickets are non-endorsable, non-reroutable and non-refundable, unless otherwise stated. It is the customer's responsibility to check the terms and conditions of air-tickets and/or other related products before, during and after purchase.
c. Industrial disputes of any kind, strikes, lock-outs, stoppage, or restraint of labour.
i) Where E-tickets are available, ONLY e-tickets will be issued via email to the email address(es) as provided during booking request submission.
ii) When traveling with E-tickets, Users are responsible to print out hardcopies of the E-tickets, if necessary.
iii) Where E-tickets are not available, Physical Tickets will be issued via dispatch delivery to the User's stated delivery address as provided during booking request submission.
iv) NToGo's Physical Tickets dispatch delivery shall be restricted only to Singapore addresses only. NToGo provides free paper ticket delivery but we reserve the right to amend, cancel and/or impose a delivery fee on the delivery service, as deem necessary by NToGo, without prior notice.
v) For Users without a valid Singapore address, be it due to wrongful entry during request submission, invalid addresses (e.g. overseas addresses, hotel addresses) or any other reasons that may lead to a failure to deliver the tickets, the Physical Ticket(s) shall be kept at NToGo's Main Office (see Contact Us) and can be picked up during office hours. In such cases, users are to call us (see Contact Us) before dropping in.
vi) Users should note that timing of Physical Ticket(s) collection is critical in respect to departure date/time. NToGo is not liable for any delay and failure to deliver due to any circumstances beyond reasonable control of NToGo. Users shall be fully responsible for his/her own timely Physical Tickets collection.
vii) For lost and re-issue of tickets, Users can Contact Us at our Singapore office, either by email or over the phone at office hours. Administrative/penalty fees may be charged where applicable (Please refer following section).
d. All amendments, cancellations and refunds are on request basis and are subject for approval by the respective airlines, ticket wholesalers and NToGo. NToGo shall not be liable to any delay or failure for any amendments, cancellations and refunds, under any circumstances.
i) An amendment processing fee (of up to SGD100) maybe levied on a case by case basis, on top of any penalties imposed by wholesalers or airlines.
ii) A cancellation processing fee (of up to SGD200) maybe levied on a case by case basis, on top of any penalties imposed by wholesalers or airlines. Unless otherwise stated, special and promotional fare air tickets may not have any refund value and thus may not entitled for any refund.
iii) A no-show fee of min SGD150 or as specified by airlines or wholesalers maybe levied on a case by case basis and shall be deducted from refund value for failing to cancel flight reservation(s). A processing fee (of up to SGD 100) maybe also be levied by NToGo.
iv) Wherever applicable, refunds for credit card payments will be made through the respective credit card or NToGo appointed credit card payment processing vendors.
2.
TOUR/FREE & EASY PACKAGES
a. Tickets are non-negotiable, non-endorsable, non-re-issuable and non-re-routable.
b. No refund for partially unused tickets and promotional fare air tickets.
c. No refund, either in full or part, will be made for any unused service arrangements not taken.
d. Minimum/maximum stay and/or ticket validity is according to fare rules made known at the time of purchase.
e. We reserve the right to cancel any booking if full payment is not made within 7 days prior to your intended date of departure in which case any deposit payment shall be forfeited.
f. Cancellation fees shall be imposed if the cancellation is initiated by you. Notification of cancellation of booking must be made in writing and received by NToGo to be effective and to avoid misunderstanding. Depending on individual package terms & conditions on a cases by case basis, the following minimum cancellation fees will be levied accordingly:
i) More than 7 days prior to departure: 50% of total tour cost or SGD 300 per person (whichever is higher).
ii) Less than 7 days or No show: 100 % of total tour cost.
g. An administrative fee of SGD 100 per person will be charged for any amendment of one component after documents are issued (ticket or hotel or sightseeing or transfer voucher). However, No Amendment is allowed within 7 days from your intended departure date as this will be treated as Full Cancellation whereby, cancellation processing fee will be charge as per condition.
h. Airlines seat and hotel accommodation are subject to availability and therefore, we shall not be liable for any unavailability of these services. We also reserve the right to automatically cancel the entire booking if any of these services cannot be secured with refund of monies paid, except for promotional air tickets where their terms and conditions apply.
i. NToGo reserves the full rights to amend flights and tour itinerary as deemed necessary, without prior notice or any compensation; however, we will make reasonable effort to avoid changes in flight and tour itinerary as stated in our website or through our communication.
j. Taxes are subject to change according to the prevailing rate of exchange and the final tax payable without prior notice, it will be confirmed at the time of issuance of travel document.
OTHERS
1. NToGo acts only as an agent for airlines, hotels, and other travel-related service providers and is not responsible for any changes made by travel suppliers, but will assist to the best of our ability, wherever possible.
2. NToGo shall not be liable for any cost, expenses, or damages whatsoever incurred or suffered by the Customer(s) which arises from any of the following events:
a. Acts of God, lighting, fire, explosion, flood, inclement weather, terrorism or accidents.
b. National or local emergency, acts of omissions of any government or governmental authority or agency, insurrection, civil disorder, war, or military operations.
c. Issuing of Tickets
d. Traffic congestion, vehicle breakdown, obstruction of any public/private road, highway, sea or air passage.
e. Accidents of any kind occurring during the Customer's independent activities.
f. Theft, robbery or lost property.
g. Food poisoning.
h. Isolation as a result of infectious diseases or any condition likely to endanger the health or safety of Customer(s) or impair their reasonable comfort.
i. Any cause beyond the reasonable control of the travel suppliers and its agents.
3. NToGo is not responsible for Users' obtaining their travel documents in time for their travel dates for tickets purchased from us.
a. It is the passenger's responsibility to obtain or have a passport with at least six (6) months validity to your intended date of departure and Visa (if required) for country of visit. More information on visas requirements is available at the embassy of the countries you are traveling to. NToGo shall not be responsible for informing or checking with the passenger on the availability of the said document.
b. NToGo cannot be held responsible or liable for any expenses, reimbursement or refund of air-ticket, tour, hotel and/or other travel-related prices if any passenger is deported or refused entry by any country on arrival or before departure or during the tour for whatsoever reasons, including to non-possession of necessary Visa.
4. Any complaints/claims must be made in writing within 2 weeks after services are rendered. No late complaints and/or claims shall be entertained.
5. Wherever possible, NToGo recommends you to take up Personal Travel Insurance policy prior to the commencement of your overseas trip or holiday. This may safe-guard your interests with respect to baggage lost/delay, flight delay, medical hospitalization, injury, illness, and/or other unforeseen events and inconveniences. NToGo shall not liable to any of the above-stated, under any circumstances.
PRIVACY POLICY
NToGo collects Users' information only where required for the processing of the air ticketing or any other travel related services as requested by the User. This information may include Users' name, passport number, contacts, addresses etc. In regard to the use of credit card at NToGo Web Site, no credit card details is ever collected nor stored by NToGo as the payment processing and verification is wholly and separately managed by our appointed Online Payment Processing Specialist partner, ChainFusion Ltd , in partnership with Citibank N.A. Singapore. NToGo reserves the right to reappoint partners as deemed fir and necessary without prior notice.

Information collected from NToGo.com Web Site will not be shared with nor disclosed to any external third parties. It will however be kept internally by NToGo for transactional records keeping purposes as well as for business planning and management as far as sales patterns and trends are concerned. However, at times, this information may necessarily be disclosed to varying extent to law enforcement agencies, strictly under an as required basis. However, NToGo shall not be liable for any leak of information, under any circumstances beyond our reasonable control.
